CONSENT FOR THE PROVISION AND PROCESSING OF PERSONAL DATA

By checking the agree box, you acknowledge that you have read, understood, and fully agreed to the terms and conditions regarding the processing of personal data by RAKSUL VIETNAM (hereinafter referred to as “EMPLOYER”), and you agree to provide your personal data to EMPLOYER under the following terms and conditions:

1. Definition

Personal data is understood as information associated with the data subject or that which helps to identify the data subject, provided by the data subject to the data controller or collected by the data controller before or during the data subject's application for positions that the data controller is currently recruiting.

In the context of the processing of your personal data:

  • You are the data subject.
  • EMPLOYER will be the data controller or data controller and processor of your personal data.
  • The party authorized by EMPLOYER to process the personal data you provide will be the data processor.

2. Personal data to be collected from you

EMPLOYER will collect the following personal data from you to fulfill the purposes specified in Article 5 of this consent:

  • 2.1 Basic personal data including:
    • First name, middle name, and last name;
    • Date of birth;
    • Gender;
    • Permanent address, temporary address, contact information;
    • Nationality;
    • Portrait photo of the data subject;
    • Phone number, national ID number, personal identification number, passport number;
    • Marital status;
    • Email address;
    • Educational background;
    • Work experience.
  • 2.2 Sensitive personal data (in case you voluntarily provide it), including:
    • Information about health status in health examination reports, information in criminal record reports provided by you (if any);
    • Information about your income level (if any);
    • Information about ethnicity, religion, and political affiliation that you are involved in (if any).

3. Processing of your personal data

EMPLOYER will either directly or through a service contract or a similar agreement, authorize the data processor to process the personal data provided by you.

Your information and/or personal data may be transferred abroad, stored, or processed outside of your country for the purposes outlined in Article 6 of this consent. EMPLOYER will only transfer your personal data abroad when in compliance with the legal regulations regarding personal data protection.

4. Who your personal data may be shared with

EMPLOYER may share your personal data with third parties, including affiliate companies, parent companies, subsidiaries, and individuals/organizations acting as consultants to fulfill the recruitment purposes of EMPLOYER.

5. Purpose of processing personal data

EMPLOYER processes the personal data you provide for the following purposes:

  • To confirm, verify, and assess the capabilities of the data subject during the recruitment process.
  • To carry out internal business management activities such as human resources, administration, accounting, security, and safety by the data controller.
  • To be used as input information when the data subject is employed by EMPLOYER.

6. Rights of the data subject

As the data subject, you will have the following rights:

  • To rectify/update inaccurate or incomplete personal data.
  • To request the data controller to erase personal information that the data controller is storing.

Additionally, the data subject has other rights as provided by law regarding their personal data.

7. Storage of personal data

The personal data of the data subject will be stored from the moment of initiating the recruitment relationship with EMPLOYER until you request EMPLOYER to delete your personal data, unless you become an employee of EMPLOYER. In that case, your personal data will be stored according to the labor laws or other relevant regulations.

8. Reference checks

EMPLOYER may conduct a background check on you either directly or through a third party acting on our behalf. The reference check will only involve information about your previous work history or within the extent permitted by law.

You ensure that you have obtained all necessary consents from your referees to provide their information in your job application profile.

9. Withdrawal of consent

At any time, you can inform us of your decision to withdraw your consent for the continued use, disclosure, storage, and/or processing of your personal data for any of the purposes outlined above. You can do this by contacting EMPLOYER using the following information:

10. Risks and security measures

The data subject acknowledges that despite the application of stringent security measures and management practices by the data controller and/or data processor, the risk of cyberattacks or data breaches cannot be entirely eliminated.

In cases of incidents or force majeure situations, the data subject understands that there is a possibility of risks arising from the unauthorized use of their personal data, which could lead to potential exposure to fraudulent activities or other unlawful actions by unauthorized users.

11. Consent to provide and allow processing of personal data

The data subject agrees to permit the data controller to process personal data as outlined in this confirmation. This confirmation may be updated, modified, and aligned with legal requirements, and it only holds value upon the agreement of the data subject.
